Terms and Conditions of the Banco Sabadell app

Object.

The purpose of this document is to establish the General Conditions of Use for this mobile application (app) called Banco Sabadell and owned by BANCO DE SABADELL (hereinafter the Bank) with its corporate domicile at Avda. Óscar Esplá, 37, 03007 Alicante, entered in the Company Register of Alicante, volume 4070, sheet 1, page A-156980, with Spanish tax code A08000143. The Bank is a credit institution under the supervision of the Bank of Spain and entered in the special administrative Register with number 0081.

The Bank reserves the right to amend these General Conditions of Use in order to adapt them to the legislation in force at any given time.

These General Conditions of Use do not exclude the possibility of certain Services of this app, due to their particular features, being subject, in addition to the General Conditions of Use, to their own specific conditions of use (hereinafter the Specific Conditions).

Use of this mobile application by Users supposes their adhesion to and express acceptance of all the General Conditions of Use in the version published on this portal at the time the User in question accesses the Portal.

Users recognise and accept that any use of the content and/or services offered by Banco Sabadell is under their own exclusive risk and/or responsibility. Users undertake to use the Banco Sabadell app and all its content and Services in accordance with the law, moral code, public order and these General Conditions of Use, and any Particular Conditions that may apply. Users also undertake to use the services and/or content of the Banco Sabadell app appropriately and not to employ them to carry out unlawful activities or those that constitute an offence, violate the rights of third parties and/or infringe intellectual and industrial copyright laws, or any other regulations of the applicable legal system.

What is the Banco Sabadell app?

Banco Sabadell is an application (mobile app) available for mobile devices of the type Smartphone and Tablet with Android and iOS operational systems, which allows Users to carry out the operations established below with products and services previously taken out with Banco de Sabadell, S.A. (hereinafter Banco Sabadell or the Bank).

What does the Banco Sabadell app allow Users to do?

With the app, Users can operate their Remote Banking service via a Smartphone or Tablet, offering all the operations listed under the details of each product:

  • + ACCOUNTS: list of movements; external transfers; transfers between accounts and cards; management of receipts, taxes and social security payments and set up new accounts.
  • + CARDS: consult movements and settlements; extend limits; personalise payment terms; send cash to cashiers; transfers to accounts; top up mobile phones and configure uses and blocks.
  • + DEPOSITS: take out new deposits and modify renewal options.
  • + SECURITIES: give orders to buy and sell and take out new securities accounts.
  • + FUNDS: list of movements; sign up with a fund and take out a new contract.
  • + PENSION AND SAVINGS PLANS: consult movements; regular or extraordinary contributions and take out new plans.
  • + FINANCING: activate Línea Expansión and pre-arranged loans and pay off mortgages in advance.
  • + INSURANCE: consult details of policies, access the management of policies and losses from the same screen.

PRODUCT CATALOGUE

The app provides information on Banco Sabadell products in a catalogue integrated within the app. This allows Users to consult all the commercial offers available on the channel and provides access to purchases, without Users needing to visit any branch. The same catalogue also provides detailed information on applications for Banco Sabadell customers.

The catalogue of products and services offered via the app can be extended by the Bank at any time, its operations within the app being subject to the terms and conditions of the product or service taken out with the Bank.

SIGNATURES VIA MOBILE

The Bank will send to the designated mobile phone number the codes required to sign remote banking operations using the Digital Signature system (which replaces signatures using a code card), as well as sending alerts related to operations and security deemed appropriate by the Bank (free of charge). If Users have already signed up for the warning and alert service, the telephone number provided will replace the one that was already linked to the aforementioned service. Digital signatures using one-off codes will have the same validity as a handwritten signature, so they should be safeguarded with the utmost diligence together with the mobile telephone, as specified in the rules of use and security, available in the Adjustments Information menu of the app.

DIGITAL FINGERPRINT

For Users with compatible Samsung, iPhone or iPad devices, the app accepts fingerprint recognition systems as an alternative to the Remote Banking access code, without this being altered or excluded as the main access code for remote channels. The processing of biometric data for this purpose has been consented by the holder of the data by explicitly signing these conditions of the app.

What do Users need to access the service?

  • They must already have a Remote Banking Service agreement and Alert Service agreement in force, as well as the access codes and signature for Banco Sabadell service operations.
  • Download the Banco Sabadell app, identify themselves using the Remote Banking Service codes and start using the app.
  • To access the different services provided by the Banco Sabadell app, Users will have to comply with different operational or contractual conditions which will be defined in each of the service functions of these Terms and Conditions.

Intellectual and industrial copyright

Users recognise that all the elements of this app and each of the Services provided through it, the information and materials contained therein, the structure, selection, ordering and presentation of its content and the computer programs used in relation thereto are protected by intellectual and industrial copyright held by the Bank or third parties.

Unless authorised by the Bank or, if applicable, by the third parties holding the corresponding rights, or at least when this is legally permitted, Users may not reproduce, transform, modify, disassemble, reverse engineer, distribute, hire, lend, make available or permit public access through any type of public communication to any of the elements mentioned in the previous paragraph.

In particular, it is absolutely forbidden to use the texts, images, announcements or any other element included within the app for its subsequent inclusion, total or partial, in other unrelated applications or websites without the Bank's prior authorisation in writing.

Users must use the materials, elements and information they access by using this app and each of the corresponding Services only for their own needs, undertaking not to commercially exploit, either directly or indirectly, any of the services or the materials, elements or information obtained thereby.

Users must refrain from suppressing symbols indicating the rights (intellectual and industrial copyright and any other kind of right) of the Bank or of the third parties present in this app and in each of the various Services offered through this. Users must also refrain from evading or manipulating any technical devices established by the Bank or by third parties, either in this app, in any of the Services or in any of the materials, elements or information obtained through this, to protect their rights.

Legal disclaimer. Liability

Availability and Stability of this Banco Sabadell application and the Services.

The Bank does not guarantee the availability, access or stability of operations of this app or its Services.

The Bank will not be liable, with the limits established by the legal system in force, for any injury or damage caused to Users as a consequence of a lack of availability, failures in access or lack of stability of this app or its Services.

Content and Services of the Bank

The Bank will only be liable exclusively for the Services provided by itself and for content directly produced by the Bank and identified with its copyright. This liability will be excluded in those cases when there are causes of force majeure or in the event that the configuration of the User's equipment is not appropriate to permit the correct use of the internet service provided by the Bank.

Content and Services of Third Parties

The Bank does not guarantee that the content, information or Services of third parties in this app are lawful, reliable, useful, truthful, accurate, exhaustive or up-to-date.

The Bank will not be liable, neither indirectly nor collaterally, for any injury or damage of any nature resulting from the use or contracting of third party Content or Services in this app, or when these are not lawful, reliable, useful, truthful, accurate, exhaustive or up-to-date. For informative purposes only, and by no means limited to this list, it will not be liable for any injury or damage of any nature resulting from the following:

a. Infringement of intellectual or industrial copyright and the defective performance or non-performance of contractual obligations acquired by third parties;

b. The carrying out of acts of unfair competition or unlawful publicity;

c. Inadequacy or unmet expectations regarding third party Services or Content;

d. Vices or defects of any kind in third party Services or content provided via this mobile app.

The exemption from liability indicated in the previous paragraphs will be applicable should the Bank not be effectively notified that the activity or information stored is unlawful or that it injures the goods or rights of a third party susceptible to compensation, or if diligent action is taken to remove the data and content or to make access to these impossible.

User Conduct

The Bank does not guarantee that the data provided by Users are truthful and accurate, exhaustive and/or authentic.

The Bank will not be liable, indirectly or collaterally, for any injury or damage of any nature resulting from the use of the app's Services and Content on the part of Users or which may arise from the data or information provided by Users not being true, accurate and/or authentic, or for the identity theft of a third party carried out by a User in any kind of action via this app. For informative purposes only, and by no means limited to this list, the Bank will not be liable indirectly or collaterally for the following:

a. The content, information, opinions and statements of any User or third parties or organisations that communicate or present themselves via this app;

b. Injury or damage caused to third parties resulting from the use, by the User, of this app's services and content;

c. Injury and damage caused due to the identity of users and any information they provide or make accessible to other users not being true, accurate or the identity being incorrect;

d. Injury and damage resulting from infringements by any user that affect the rights of another user, or of third parties, including the rights of copyright, trademarks, patents, confidential information and any other right of intellectual and industrial property.

Contracts with third parties

Users recognise and accept that any contractual or extracontractual relationship which may be established with third parties entered into via this app is understood as being carried out solely and exclusively between the User and the third party. Consequently, Users accept that the Bank cannot be held liable at all for any injury or damage of any nature caused by their negotiations, conversations and/or contractual or extracontractual relations with the legal or physical third parties contacted or dealt with via this app.

Technical link devices

The Bank is exonerated from any liability concerning the technical availability of any linked portals, for the quality, reliability, accuracy and/or truthfulness of the services, information, elements and/or content which Users may be able to access on these.

The Bank will not be liable, indirectly or collaterally, for any injury or damage of any nature resulting from the following:

a. The functioning, non-availability, inaccessibility or lack of stability of the Service for reasons not attributable to the Bank.

b. The lack of maintenance or updating of the content and services contained on the linked portals;

c. The lack of quality, inaccuracy, unlawfulness, non-usefulness of the content and services of the linked portals.

Resolution

Notwithstanding any liability for injury or damage that may result, the Bank may, immediately and without the need for advance warning, rescind and terminate its relation with users, interrupting their access to the app, to its corresponding Services, if it detects a use thereof or of any of the Services related thereto that contravenes the general or particular conditions that may be applicable. Users will be responsible for any injury or damage of any nature which the Bank or any of its subsidiaries may suffer, directly or indirectly, as a consequence of not performing any of the obligations resulting from the general or particular conditions related to the use of this app or of any of the Services linked to it. Similarly, users will hold the Bank and its subsidiaries harmless in the case of any penalty, complaint or statement of claims that may be brought by a third party, including any public body, against the Bank, its employees or agents as a consequence of any third party rights being violated by this User by using this app or the services linked to it in a manner that contravenes that established in the general or particular conditions that may be applicable.

Various

Amendments.

The Bank reserves the right to carry out the modifications it deems opportune, being able to amend, eliminate and incorporate new content and/or services, as well as the manner in which these are presented or located.

Minors.

In general, access to make use of this app's Services is restricted to minors. In those Services where this is expressly stated, minors will be able to have access, restricted solely and exclusively to the Services stated, and they must have previously obtained permission from their parents, tutors or legal representatives, who will be liable for all acts carried out via this app by the minors under their charge.

Duration and termination.

The provision of this app's services and/or content has an indefinite duration. Notwithstanding the above, the Bank is entitled to terminate, suspend or interrupt unilaterally, at any time and without the need for advance warning, the provision of the service and of this app and/or any of the services, notwithstanding that established in this respect in the corresponding particular conditions.

Law and jurisdiction.

Any issues regarding the app are governed by the laws of the Kingdom of Spain and come under the jurisdiction of the User's domicile. Should the User's domicile be outside Spain, the Bank and the User will accept, expressly renouncing any other jurisdiction, that of the courts and tribunals of the city of Barcelona (Spain).

Synchronisation

Use of this app allows the synchronisation of data and information managed by Users on their mobile terminal. Users are aware and accept this synchronisation and transfer of information between the app and the mobile device.

Applicable law and competent jurisdiction

All issues regarding the use and contraction of the Service are governed by Spanish law and come under the jurisdiction of the competent Courts and Tribunals of the Kingdom of Spain.
